These general terms of use (Terms of Use) define the specific conditions for using the Klytic Mail service offered by DEDICACE SOFTWARE (Mauritius) LTD (hereinafter "the Provider") to its business customers (hereinafter "the Customer").
They supplement the Provider's general terms and conditions (GTC), which remain applicable to any subscription to the service.
Subscription to and use of Klytic Mail imply acceptance without reservation of these Terms of Use.
Each Klytic Mail account automatically includes the Klytic MTA Essential service, intended in particular for filtering and protecting email flows associated with the account.
Use of Klytic MTA Essential is inseparable from the Klytic Mail account and does not constitute a separate subscription by the Customer.
By subscribing to or using a Klytic Mail account, the Customer also acknowledges having read the Klytic MTA general terms of use and accepts them without reservation for use of the Klytic MTA Essential functionality.
The Klytic MTA Terms of Use apply to Klytic MTA Essential insofar as they are compatible with the features and limitations of the Essential offering.
Subscription to a separate Klytic MTA offering, when available, is subject to the subscription conditions and Klytic MTA Terms of Use applicable to that offering.
Klytic Mail is intended for professional use, in compliance with applicable laws and regulations.
The Customer is responsible for use of the service by its users and undertakes in particular not to use the service to:
- send fraudulent, misleading, or unlawful communications;
- distribute content contrary to law, third-party rights, or public order;
- send unsolicited bulk messages or participate in spam campaigns;
- distribute malicious software, viruses, links, or attachments intended to compromise a system;
- impersonate a third party or use an address or domain under conditions likely to mislead recipients;
- circumvent security, filtering, or authentication mechanisms;
- compromise or attempt to compromise the Provider's systems or those of third parties.
The Customer also ensures compliance with applicable rules regarding commercial prospecting, personal data protection, intellectual property, and confidentiality.
Each user must have their own account. Sharing credentials among multiple persons is prohibited, except when a specific service mechanism expressly provides for shared access.
The Customer is responsible for managing its users' accounts, including their creation, modification, deactivation, and deletion.
Credentials, passwords, recovery codes, keys, authentication tokens, and other elements allowing access to the service are strictly confidential.
The Customer and its users are prohibited in particular from:
- disclosing their credentials to an unauthorized third party;
- storing access codes in an unsecured location;
- reusing a compromised password on other services;
- disclosing an authentication code received by SMS, application, or other means to a person requesting it;
- disabling or circumventing security mechanisms in place.
Any password or authentication secret initially provided must be changed when the service or the Provider requests it. Passwords must also be renewed without delay in the event of suspected compromise, loss of confidentiality, or change of authorized person.
The Customer must report any compromise or suspected compromise of an account to the Provider without delay.
When multi-factor authentication is available, the Customer is encouraged to activate it and make it mandatory for accounts with administration rights.
The Customer chooses, upon subscription, the storage capacity suited to its needs.
The Customer is responsible for ensuring this capacity is adequate for its use and must anticipate any increase in its needs.
When the subscribed capacity becomes insufficient, the Customer must request an increase within a timeframe allowing implementation before maximum capacity is reached.
The Provider cannot be held responsible for consequences arising from insufficient storage capacity resulting from the Customer's failure to anticipate or request an increase.
Any capacity reduction may be subject to technical conditions and, when it requires Provider intervention, may be invoiced based on a quote.
The Customer is responsible for the domain names, email addresses, and information it uses in connection with the service.
It is the Customer's responsibility to ensure it has the necessary rights to the domain names used and to keep information relating to their management up to date.
The Customer is also responsible for configuring DNS records for which it is responsible when these are not managed by the Provider.
The Customer must implement security measures appropriate to its activity.
In particular, it is the Customer's responsibility to:
- keep workstations and devices used to access the service up to date;
- protect terminals against malicious software;
- limit administration rights to persons who need them;
- promptly deactivate accounts of persons who have left the organization;
- raise awareness among its users of the risks of phishing, identity theft, and disclosure of confidential information;
- implement enhanced authentication when possible.
Security and filtering mechanisms implemented by the Provider constitute protective measures and do not relieve the Customer of its own security obligations.
The Customer remains responsible for messages sent and received by its users as well as content, attachments, links, and data processed using the service.
The Customer is liable for consequences resulting from use not in compliance with these Terms of Use by itself, its users, or any person to whom it has granted access to the service.
In particular, the Customer must take all necessary measures to prevent a compromised account from being used to distribute spam, malicious software, or unlawful content.
The Provider implements security measures appropriate to the service and its infrastructure.
In the event of detection of behavior likely to compromise the security of the service, other users, or third parties, the Provider may take any measure necessary to protect its infrastructure, including temporarily limiting, suspending, or blocking an account or email flow.
When possible, the Provider informs the Customer of the measure taken and its reasons.
Certain features or uses may require specific resources or configurations.
When the Customer's needs exceed the capacities provided in its offering, particularly due to an exceptional volume of messages, a large number of users, or particularly intensive use, an infrastructure adaptation or additional services may be proposed on a quote basis.
Without prejudice to the provisions of the GTC, the Provider may temporarily suspend all or part of the service when use presents a risk to the security, integrity, or availability of its infrastructure, that of its customers, or third parties.
Suspension is limited to what is necessary to stop or contain the risk.
Provisions relating to personal data processing, confidentiality, backups, and reversibility are defined in the GTC and, where applicable, in the applicable DPA.
The Customer remains responsible for retaining data it needs and must, when necessary for its activity, implement its own additional backup or archiving measures.
Subscription to Klytic Mail constitutes acceptance of these Terms of Use, without prejudice to acceptance of the GTC and any additional contractual documents applicable to the Customer.
